How the FAA can steal your time off with OPM assistance
I recently learned a valuable lesson about government employment after almost 40 years as a government employee.The government can force an employee to forfeit annual leave.Employees have no right to leave restoration because the supervisor/FAA can simply chose to ignore the request. FAA supervisors are not required to answer a leave reqested by SF71/OPM71. No denial, no leave restoration.
This is a valuable tool for supervisors as it can be used to punish employees who complain about incompetence, mismanagement and/or fraud. I learned that a supervisor can restore leave for one employee and deny it for another employee even when the leave was forfeit at the same time for the same reasons.
U.S. Office of Personnel Management has issued a decision that management has no obligation to approve or disapprove leave that is requested by OPM form 71.If management would like to force an employee to forfeit leave, the manager has to only ignore the form 71.The organization will assert, and OPM will agree that because leave was requested 3 months before the end of the year (never approved/denied) the employee had the ability to use the leave.Neither OPM nor the government agency explains how an employee can somehow force a supervisor to approve/deny the leave or retain the OPM/SF71.
I have attached below my complaint and the OPM response about 5 years of leave forfeitures.I would love for someone to explain how I might have gotten my employer to approve leave or deny it making restoration possible.
Before you complain to management about mismanagement, incompetence or other management wrongdoing, especially if the complaint involves mismanagement/incompetence that may endanger a major metropolitan area, remember that you too can be forced to forfeit annual leave (among other punishments). iwas fortunate, I could retire; so I did.
As a 68 year old black man with stage 4 cancer the FAA probably won't have to worry about me for long. Don't think they ever cared anyway. Always considered Frank "blood money, billions wasted" Hatfield and James "Hudson river photo op" Johnston the worst supervisors/managers I saw in my 40 years in government.
